1. Overview
Welcome. These Terms of Service ("Terms") govern your use of TrySpeak.ai (the "Services"), including our web and mobile applications, AI language tutors, courses, role‑play scenarios, pronunciation scoring, certificates, and related offerings. By accessing or using the Services, you agree to be bound by these Terms, including the policies referenced herein.
QLian I.O.T US LLC ("TrySpeak," "we," "us," or "our") operates TrySpeak.ai. If you do not agree, do not use the Services.
2. Definitions
- AI Language Tutor: The AI‑powered conversational agent(s) that provide language instruction, dialogue practice, grammar corrections, and feedback.
- Services: All features, content, and tools offered by TrySpeak.ai, including but not limited to lesson courses, role‑plays, pronunciation scoring, certificates, audio downloads, and partner integrations.
- User / You: Any individual or entity that accesses or uses the Services.
- Content: Any text, audio, images, or other data provided to or generated by the Services, including your inputs and the AI‑generated outputs.
- Account: A user profile registered via email, social sign‑in, or other authentication methods.
3. Eligibility & Accounts
3.1 Age & Capacity
You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to create an account and use the Services. If you are under 18 (or the applicable age of majority), you represent that you have obtained your parent or legal guardian's permission. We may request proof of parental consent or verify age at any time. Youth Protection features (see Section 6) are available for minors.
3.2 Accuracy
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
3.3 Security
You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
3.4 Account Type
Individual accounts are for personal, non‑commercial use. Institutional accounts (e.g., schools, companies) may have separate terms (see Section 5).
4. Services & Features
TrySpeak provides a range of AI‑powered language learning tools, including but not limited to:
- AI Language Tutors: Multi‑language conversational agents for dialogue practice, vocabulary building, and grammar correction.
- Courses & Lessons: Structured content organized by proficiency level (beginner to advanced), topic, and language.
- Role‑Play Scenarios: Thousands of real‑world and professional situations to practice practical communication.
- Pronunciation Scoring: AI‑based evaluation of pronunciation, intonation, and fluency.
- Audio Downloads: Downloadable audio files from lessons and dialogues for offline practice.
- Certificates: AI Language Certificates that document your study time, vocabulary learned, conversation count, and estimated CEFR level (A1–C2), with QR verification.
- Exam Preparation: Training for international language tests (e.g., IELTS, TOEFL, DELE).
Features and availability may vary by plan and region. We reserve the right to modify, add, or discontinue features with notice.
5. Institutional & Partner Accounts
Educational institutions, enterprises, or partners may have separate licensing agreements or addenda that supplement or override portions of these Terms. If you access the Services through an institutional account, your organization's policies may also apply. Contact us for enterprise or institutional licensing.
6. Youth Protection (Teen Mode)
Minor Protection Toggle. We provide a "Minor Protection" or "Teen Mode" setting that, when enabled, filters out adult‑themed scenarios and content. Parents and guardians are encouraged to enable this feature for users under 18.
Moderation. All interactions with AI tutors are moderated for age‑appropriate content, regardless of mode. However, AI systems may occasionally generate unexpected outputs. We continuously improve our filters; if you encounter inappropriate content, please report it immediately via [email protected].
Parental Supervision. We recommend that parents or guardians supervise minors' use of the Services and review the conversation logs available in the account settings.
7. Acceptable Use
You agree to use the Services only for lawful purposes and in compliance with these Terms. You will not:
- Violate any applicable laws, regulations, or third‑party rights.
- Post, share, or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation.
- Attempt to reverse engineer, decompile, or extract the underlying models or algorithms of the Services.
- Use automated tools (bots, scrapers, etc.) to access the Services without prior written consent.
- Interfere with or disrupt the integrity or performance of the Services or servers.
- Upload viruses, malware, or any malicious code.
- Use the Services to spam, phish, or engage in any fraudulent activity.
- Bypass or circumvent rate limits, usage quotas, or security measures.
- Use the Services to generate content for resale, redistribution, or competitive products without a separate commercial license.
Violation of these policies may result in account suspension or termination.
8. Fair Use & Rate Limits
To ensure quality service for all users, we implement fair use policies and rate limits. Excessive or abusive usage (e.g., excessive API‑like queries, automated bulk requests) may result in temporary throttling or account review. Paid plans may have higher or different limits.
9. Your Inputs & AI Outputs
9.1 Your Inputs
You retain ownership of any content you submit to the Services (e.g., text, audio recordings). By submitting content, you grant TrySpeak a worldwide, non‑exclusive, royalty‑free license to use, process, store, and display your inputs to provide, improve, and maintain the Services, including to train and refine AI models. You represent that you have all necessary rights to the content you submit.
9.2 AI Outputs
AI‑generated outputs (e.g., dialogue responses, corrections, pronunciation scores, audio files, and generated text) are provided to you subject to these Terms. You may use AI outputs for personal, educational, or non‑commercial purposes. Commercial use of AI outputs (e.g., resale, publishing, or integration into other products) requires a separate commercial license or written permission from TrySpeak.
9.3 Accuracy & Limitations
AI outputs are machine‑generated and may contain errors, inaccuracies, or biases. They should not be relied upon as the sole source of truth for critical decisions. Always verify important information with qualified sources.
10. Intellectual Property
TrySpeak IP. All rights, title, and interest in the Services, including but not limited to software, designs, trademarks, logos, course materials, and AI models, are owned by TrySpeak or its licensors. These Terms do not grant you any ownership rights to TrySpeak's intellectual property.
Feedback. If you provide feedback, suggestions, or ideas to TrySpeak, you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use and incorporate such feedback without compensation or attribution.
DMCA / Copyright. If you believe your copyrighted work has been infringed, please contact us at [email protected] with details as required by the Digital Millennium Copyright Act (DMCA).
11. Plans, Free Tier, Subscriptions & Billing
- Free Forever Plan (not a trial). TrySpeak offers a free plan that is not a time‑limited trial. Each day you receive a free quota to use the Services (e.g., dialogue learning, scenario training, vocabulary, grammar corrections, pronunciation practice, and teacher audio downloads). No credit card is required to access the free plan.
- Upgrade triggers. We will only prompt you to upgrade to a paid plan if (a) you exceed your daily free quota; or (b) you choose to access premium/advanced features that are designated as paid features.
- Payment methods. Paid access is offered via Subscriptions (auto‑renewing unless you cancel) and One‑Time Purchases (a single charge that unlocks specified features, content, or usage).
- Subscriptions. Subscriptions renew automatically until cancelled. You can cancel in your account settings before the renewal date to avoid future charges.
- One‑Time Purchases. One‑time purchases grant access to the specified feature set or content as described at the time of purchase. They do not auto‑renew.
- Pricing & taxes. Prices and available plans may change with notice. Taxes are additional where applicable. Billing is handled by PCI‑compliant processors; we do not store full card numbers.
12. Refunds & Cancellations
Unless required by law or expressly stated in an offer, fees for Subscriptions and One‑Time Purchases are non‑refundable. If we materially fail to provide the advertised Services and cannot remedy the issue within a reasonable period after you contact support, we will work with you in good faith to make it right as permitted by applicable law.
- Subscription cancellation. You may cancel at any time in your account settings; cancellation stops future renewals/charges but does not retroactively refund the current period.
- One‑Time Purchases. One‑time purchases are not recurring and are generally non‑refundable once delivered, except where required by law.
13. Third‑Party Services & Providers
We may link or integrate with third‑party services (e.g., AI model providers, speech processing, analytics). Their terms and privacy policies apply to their services. TrySpeak is not responsible for third‑party content or offerings.
14. Privacy
Your information is handled per our Privacy Policy. Certain regions may require consent for analytics or voice processing.
15. Availability; Support
We strive for high reliability but do not guarantee uninterrupted access. Support response times vary by plan; Plus/paid plans receive priority where available.
16. Disclaimers
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant accuracy, fitness for a particular purpose, or non‑infringement to the fullest extent permitted by law.
17. Limitation of Liability
To the maximum extent permitted by law, TrySpeak and its affiliates' total liability for claims relating to the Services is limited to the greater of USD $100 or the amount you paid to TrySpeak in the 12 months before the claim.
18. Indemnification
You will defend and indemnify TrySpeak and its affiliates from claims arising out of your misuse of the Services, violation of these Terms, or infringement of third‑party rights.
19. Governing Law & Venue
These Terms are governed by the laws of the State of Mississippi and the United States, without regard to conflict‑of‑law rules. For any dispute not subject to arbitration or small‑claims, the exclusive jurisdiction and venue shall be the state courts located in Hinds County, Mississippi or the U.S. District Court for the Southern District of Mississippi (Jackson Division), except where applicable law provides otherwise.
20. Export Controls & Sanctions
You must comply with applicable export, re‑export, and sanctions laws. You may not use the Services if you are located in, or are a national of, a restricted territory, or are on a restricted party list.
21. Changes to Services/Terms
We may modify or discontinue features. Material changes to these Terms will be notified in‑product or by email. Continued use after changes indicates acceptance.
22. Suspension & Termination
You may stop using the Services at any time. We may suspend or terminate access for violations of these Terms, legal requirements, or risk to the platform or users.
23. Miscellaneous
- Entire Agreement: These Terms and referenced policies are the entire agreement.
- Severability: If a provision is unenforceable, the rest remains effective.
- No Waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign without consent; we may assign in connection with a merger, acquisition, or sale of assets.
- Notices: We may contact you via the email associated with your account or in‑product notices.
